Knowing About Dual Agency. Dual agency is a means to allow real estate agents, under Illinois law and with full disclosure, the ability to act on behalf of more than one party when both parties are clients. Although the likelihood of dual agency becoming a part of your transaction is small, it is essential that you understand the process and that the procedure includes fairness and the ability for the agent to act without favoring one client over the other. The choice is YOURS. We will explain all the advantages and disadvantages of dual agency BEFORE it potentially arises. Disclosure always comes first. In Illinois virtually ALL sellers must fill in a proper “Seller’s Disclosure” in order to divulge important information about the home that they are selling. In addition ALL home that were built prior to 1978 also require a Lead Paint Disclosure. We will guide you through this process.
